1 – Definitions

In these conditions the following expression shall have the following meanings:

(a) The ‘Company’ means Duckworth & Kent Ltd, Terence House, 7 Marquis Business Centre, Royston Road, Baldock, Hertfordshire, SG7 6XL, England.

(b) The ‘Customer’ means the party with whom the Company is contracting.

(c) The ‘Goods’ means the products, articles, materials or services which are supplied by the Company to the Customer.

(d) The ‘Contract’ means the contract for the sales of the Goods by the Company.

2 – General

Any quotation given by the Company is an invitation to the Customer to place an order. We endeavour to respond to all orders within 24 hours between Monday to Friday.

3 – Prices

All prices listed are in Pounds Sterling (£) excluding VAT and postal charges and are dispatched to a hospital, treatment centre or surgeon with a postcode within the United Kingdom (excluding Northern Ireland). Alternatively, customers are welcome to visit the factory to collect their orders, as long as email notification of time and day has been given to our customer services team.

Prices may be subject to change without notice and shall not be used by the customer for distribution to a third party or to solicit competitive pricing.

4 – Payment

Payment should be before despatch of the Goods or already agreed payment terms.

5 – Delivery

We aim to ship within 2 weeks of receiving your order, should this not be the case the Customer will be advised of the exact despatch date.

6 – Guarantee

Goods are covered by a lifetime guarantee against faulty material or workmanship.

7 – Return of Goods

To qualify for a refund a return must meet both of the following criteria:

• The product must be within its original packaging with sealed “D&K” stickers still undisturbed
• Returned within 30 days of purchase

On meeting the above criteria, instrument(s) will be evaluated prior to any potential refund. If the instrument(s) pass(es) evaluation, then a refund will be given to cover the cost of the instrument(s) but will not include shipping costs.

Opened instruments and those returned beyond 30 days of purchase will not qualify for a refund.

8 – Title

The title of Goods shall not pass to the Customer until payment has been made at the full invoiced price.

9 – Law

The Contract shall be governed by and construed in all respects in accordance with English Law and the Company and the Customer irrevocably submit themselves to the exclusive jurisdiction of the English Courts.
